Terms and Conditions

Welcome to Housing Disrepair Specialist. These Terms and Conditions govern your use of our services and your relationship with us.

Definition of Terms

For the purposes of these Terms and Conditions:

We, Us and Our

Means QuickLeap Ltd (and all of its trading names), whose registered office is Newsham House, 103 Manchester Road, Bury BL9 0TD

QuickLeap

Is a trading style of QuickLeap Limited. We are authorised and regulated by the Financial Conduct Authority.

You and Your

Means You the person/s entering into this Agreement.

Your Loan

Means the Secured Loan / Mortgage sold or provided to you.

The Lender / Broker

The regulated financial institution(s) or other provider(s) responsible for the advice provided and sale of your Loan, against whom we will contact to identify whether you have a potential claim.

Solicitor

The Solicitor Regulation Authority (SRA) regulated legal service provider who will process your claim on your behalf.

Fees

Any payments that are received by us for the claim identification services that we provide.

Claim

A claim or claims made by your appointed solicitor to the broker / lender on your behalf, relating to one or more of your loan products.

Loan related claims

Any claim made by Your Solicitor to the broker / broker on your behalf relating to the advice, sale, and ongoing management of your Loan.

Expert

A lending expert, who you or your solicitor may instruct to carry out a comprehensive audit of your loan paperwork.

Scope of Work

Our services include the following:

  • We will collate information from you and correspond with your lender / broker to request documents.
  • We will commence with a summary audit regarding this information, and where we identify that you may have a potential claim, we will liaise with your solicitor and expert in respect of your claim/s.
  • Should your claim/s not be accepted by the Solicitor, we will close our file.
  • We will keep you informed of the progress of identifying your potential claim, and once you have instructed your solicitor they will take over the responsibility of keeping you updated on the progress of your claim.
  • Other than the actions referred to above, we will not be obliged to take any action on your behalf, unless we otherwise agree in writing.

No Guarantee

We give no guarantee and make no representation that any claim/s that your solicitor makes on your behalf will be successful, or that your solicitor will be able to recover any particular sum of money, or achieve any particular result, for you and you agree not to hold us liable for any amounts your solicitor is unable to recover.

Fees

Our fee structure is designed to be completely risk-free for you:

  • On successful completion of your claim/s, you pay us NOTHING, our fee is paid directly by your solicitor for identifying and referring your potential claim to them.

You may be charged a fee by your solicitor for processing your claim, these fees will be detailed, and agreed by you, prior to your solicitor commencing with your claim.

Your Obligations

5.1. Document Provision

You must promptly provide to us, at no cost to us, copies of any documents in your possession (in relation to the claim), and with any other information, that we ask for at any time.

5.2. Full Disclosure

You must make full, frank and prompt disclosure to us of all facts that you believe are relevant to your claim/s, and not deliberately mislead us at any time.

5.3. Authorization

You must promptly provide to us, at no cost to us, any authority we ask for at any time, authorising us to carry out our obligations under this agreement.

Termination, lien and set off

We do not charge a fee for cancellation.

General

7.1. Agreement Amendments

This agreement may be amended from time to time, without notifying you.

7.2. Alternative Redress Options

You are not required to use a solicitor to pursue your claim. You have the right to go direct to your Lender / Broker, or to use the Financial Ombudsman Service (www.financial-ombudsman.org.uk) to seek redress independently and free of charge.

You may also have the right to claim via the Financial Services Compensation Scheme (FSCS) for free, if you have been mis-advised and the firm (that advised you / provided the Loan) has since failed – more information can be found at www.fscs.org.uk.

7.3. Data Protection

For the purpose of any data protection legislation, as amended from time to time, you agree that we, and our associates, may collect, store, process and retain personal and sensitive data relating to you in carrying out our duties under these Terms. For full details please refer to our Privacy Policy which is available online and can be provided upon request.

7.4. Governing Law

The construction, validity and performance of this agreement will be governed by and interpreted in accordance with English Law and you and we agree that the English Courts will have exclusive jurisdiction over such matters, however we will have the right to take action against you in relation to this agreement in any Court, in any country, if we feel that it is necessary.

Complaints Procedure

We pride ourselves on providing a professional service. If you are not happy with our service in any way, we would like to hear about it. A full copy of our complaints policy and procedure can be provided on request.

Changes to These Terms and Conditions

We may update these Terms and Conditions from time to time. We will notify you of any changes by posting the new Terms and Conditions on this page.

You are advised to review these Terms and Conditions periodically for any changes. Changes to these Terms and Conditions are effective when they are posted on this page.
